Terms & Conditions

1. General

A Contract (The “Contract”) will only come into being upon acceptance by Bostitchtools.co.uk of the customer’s verbal order or given in writing, or via electronic means and the following shall be deemed to be incorporated therein. All terms and conditions appearing or referred to in the customer’s order or otherwise stipulated by the customer shall have no effect. Any variation in the contract must be in confirmed by Bostitchtools.co.uk in writing. Bostitchtools.co.uk reserves the exclusive right to amend or update the terms and conditions without prior notice to the customer at any time. It is the sole responsibility of the customer to familiarise themselves with our terms and conditions on a regular basis. It is up to the customer (Buyer) to ensure that goods ordered from our site are suitable for the applications that the end user requires them for

2. Price

Where goods are sold by reference to Bostitchtools.co.uk website the price payable for the goods shall be based on the manufacturers published price list at date of dispatch, otherwise prices shall be charged on the basis of Bostitchtools.co.uk quotation to the customer. Quotations shall be deemed to be valid for a maximum of Ten days or the end of the month whichever is the sooner. Bostitchtools.co.uk reserve the right to amend any quoted price without delay should the manufacturers price be altered at source. Prices do not include carriage until calculated. We reserve the right to apply a delivery charge or increase in the delivery charge for exceptional orders. By exceptional orders we mean bulk orders for items that result in a weight increase that would not be sent in a box normally around 15kgs in weight. We would notify you of this charge before dispatching your order. Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a Product has a correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.

3. Warranty

Where machines are returned under warranty, they will be repaired or replaced in accordance with the manufactures terms and conditions. Warranty DOES NOT INCLUDE return carriage to the manufacturer, electrical motors unless, hard wired into suitable wiring with sufficient capacity, O rings, driver blades, routine service work or repairs necessitated by misuse or incorrectly lubricated (i.e. any penetration oil or other type not specifically pneumatic tool oil). Where new parts are supplied or fitted under warranty by Bostitchtools.co.uk or the manufacturer, the new items shall only be covered to the end of the original warranty period on the item supplied.

4. Returned / Damaged Goods

All goods returned at our discretion, carriage paid by the customer. All claims for damaged goods must be verbally made within one working day of receipt of goods, followed by a written claim within three working days . No returns will be accepted without prior authorisation in writing from Bostitchtools.co.uk . Non damaged Goods returned are subject to a 25% of the invoice total for restocking goods. Goods specifically ordered that are non-stock items are non-returnable. Goods returned must be in a re-saleable condition and seals must be intact. Export orders cannot be returned for any reason.

6. Payment Terms

All orders taken through our website will be paid before the customer leaves our site. All payments shall be made without deduction or set off. Bostitchtools.co.uk reserves the right to charge interest on overdue accounts calculated by the recognised method of the total invoice amounts. All overdue debts will be handed to our debt collection agents (Direct Route Collections Limited) & shall be dealt with by them on our behalf. All incurred costs shall be passed to the debtor and shall be added to any outstanding monies due. At this point no further direct communication shall be made by Bostitchtools.co.uk. All Cheques presented in full or part payment for goods supplied by Bostitchtools.co.uk that are not cleared by the bank account of the payee or are referred back to the drawer or are stopped by the payee shall be surcharged at £25.00 per item.

7. Retention of Title

Until payment is made in Full for the goods or services comprised on any sale or a supply of service contract between Bostitchtools.co.uk and the customer, has received the goods comprised on each and every contract, remain the property of Bostitchtools.co.uk (Although the risk therein passes to the buyer at the point of the delivery begins.)

8. Liability

Bostitchtools.co.uk shall not be liable to the customer for any losses of whatever nature, direct or consequential and all warranties, conditions, or other terms implied by stature or common law as to standard of performance, fitness for purpose, merchantability or any other are hereby excluded to the fullest extent permitted by law. Every reasonable effort will be made to complete the service or supply of goods in a reasonable time but Bostitchtools.co.uk shall not be under liability to the customer whatsoever for any loss of whatever nature occasioned by delay in performance of the service, repair or supply of the goods arising out of any cause whatsoever so long as all terms & conditions have been met.

9. Repairs

Each part used as part of the service or repair carried out will remain the legal property of Bostitchtools.co.uk until full and final payment of all amounts owing to Bostitchtools.co.uk by the customer has been made. When goods are returned by Bostitchtools.co.uk. The Customer agrees by signature that the work has been carried out to their full satisfaction. Bostitchtools.co.uk reserves the right to cancel or halt any repair whatever the state of progress without any liability should the buyer fail to comply with any of our standard terms & conditions.

10. Delivery Charges

Carriage will be chargeable for the transportation or other special express carrier services as needed. All shortages must be reported verbally within twenty four working hours and followed in writing within three working days of delivery as per our UK carrier standard terms and conditions

11. Time Limits for Delivery Claims

We will not be liable for damage to a consignment or any part thereof or loss from a consignment that is noted as damaged or loss upon a consignment note or other delivery document unless a written claim is made in writing within 10 calendar days after the delivery has ended. Damage to a consignment or any part thereof or loss from a consignment that is NOT noted as damaged or loss upon a consignment note or other delivery document unless the carrier be advised thereof by the customer or the consignee in writing (email) or by telephone by 13.00hrs on the next working day after delivery has ended and a claim is made is made in writing within 5 working days

VAT

All prices shown, quotes given and services supplied are subject to VAT that will be charged at the rate ruling at the date of sale. Export orders to EC member states will be zero rated if a valid European VAT number is provided. All other worldwide exports shall be zero rated.

12. Forbearance

Any forbearance, indulgence or relaxation on the part of Bostitchtools.co.uk shown or granted to the customer on any particular occasion in respect of any of the provisions of the contract shall apply on that occasion only and shall not otherwise affect, diminish, restrict or prejudice the rights or powers of Bostitchtools.co.uk under the contract or operate as or be deemed to be a waiver of any breach by the customer of the terms and conditions of the contract.

13. Applicable Law

The contract (And any proceedings whereby one party might be entitled to join the other party as a third party.) Shall in all respects be governed by and consulted in accordance with English law and the parties hereby submit to the exclusive juristic ion of the English courts.

14. Safety

Goods are supplied in all good faith but it is the purchases final responsibility to ensure that the goods in question are used & meet in full the provisions of the Health & Safety at work act or legal requirements applicable in the country of use.
